Terms and Conditions for participants in the Rewards Program
1. Scope of these Terms and Conditions
Participants in the Rewards Program can earn credits through various actions on the Studydrive platform, such as uploading documents and index cards, and redeem them for rewards in the Rewards Store.
2. Rewards Program
The Rewards Program is organised by the Studydrive GmbH, Am Postbahnhof 17, 10243 Berlin.
2.1 To participate in the Rewards Program, users must register on the Studydrive platform. In order to receive a reward, users must redeem virtual credits received for various actions on Studydrive for rewards in the Rewards Store at https://www.studydrive.net/en/rewards. By clicking the "Order" button, the order of a reward is binding.
2.2 Participants can redeem their credits for a reward when they reach a certain credit score. The current rewards catalogue is available at https://www.studydrive.net/en/rewards.
2.3 Participants can only redeem rewards in the Rewards Store of a country in which they are enrolled. The decisive factor for this is the location of the university that is specified as the place of study in the user profile at the time of the order process.
2.4 Credits to be redeemed in the Rewards Store must have been collected predominantly in the country the Rewards Store is targeting. Predominantly means that more than half of the credits to be redeemed have been collected in the country of the Rewards Store.
2.5 Credits obtained through unauthorized means (such as bots, fake accounts or unauthorized uploads such as entire books or other documents from publishers, individual photos of multi-page documents, or other non-study-relevant or copyright-protected materials) or through any other violation of platform rules will be deducted from the credit score accordingly and may not be exchanged for rewards. If such credits are nevertheless redeemed in the Rewards Store, Studydrive may withdraw from the contract and demand the return of or compensation for the value of the reward.
2.6 Deletion of documents affects the credit score of the participants. Credits earned with the removed document will be deducted from credit score accordingly and may not be exchanged for rewards. Studydrive reserves the right to withdraw from the contract and demand the return, or compensation for the value of the reward, if a reward was purchased with invalid credits or credits that were later declared invalid.
2.7 Complaints or requests for changes to the country-specific Rewards Store or the country of the study location must be sent via email to info@studydrive.net within 14 days of the reason becoming known, stating the user profile.
3. Data Protection
Studydrive GmbH, Am Postbahnhof 17, 10243 Berlin, Germany, is responsible for the collection, processing and use of personal data within the framework of the Rewards Program.
Studydrive treats the personal data of participants confidentially. Any collection and processing of participants' personal data is carried out in compliance with the applicable data protection laws. Further information on the use of personal data can be found in Studydrive's privacy policy at https://www.studydrive.net/en/tag/privacy-policy.
The data collected within the framework of the Rewards Program will be used for the execution of the Rewards Program (for credit administration and sending of the rewards). The participants’ master data will be deleted when they are no longer required for the allocation of existing credits to participants and the sending of rewards. For the correction, deletion or blocking of data or information on stored Rewards Program data, participants can contact Studydrive GmbH, Am Postbahnhof 17, 10243 Berlin, Germany, by (i) email to info@studydrive.net or (ii) by mail, stating the specific request.
4. Liability
Studydrive shall be released from all obligations upon delivery of the reward, unless an earlier point in time results from the present regulations. Studydrive shall not be liable for defects in title and/or quality of the rewards sponsored by cooperation partners.
5. Changes of these Terms and Conditions
In the event of changes to these terms and conditions, Studydrive will notify the participants in advance. If participants do not agree with the changes, they can terminate the contractual relationship by (i) email to info@studydrive.net or (ii) by mail to Studydrive GmbH, Am Postbahnhof 17, 10243 Berlin, Germany, until the change comes into effect. If participants do not make use of the option to terminate the contract, the amended terms and conditions will become effective at the time of the notified amendment. Studydrive will point this out to the participants in the notification.
6. Cancellation and Termination of the Rewards Program
6.1 Studydrive reserves the right to terminate the Rewards Program at any time without prior notice. Studydrive will make use of this possibility in particular if proper implementation cannot be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons. If such a termination is caused by the behaviour of a user, Studydrive may demand compensation from this person for the damage incurred.
6.2 This does not affect the right of both contracting parties to terminate the contract in writing, including by e-mail, as stated in section 5, for good cause.
7. Miscellaneous
7.1 The law of the Federal Republic of Germany shall apply to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods. Legal norms that refer to another legal system shall not apply. The exclusive place of jurisdiction for all legal disputes arising from or in connection with these conditions of participation is, as far as legally permissible, the registered office of Studydrive GmbH.
7.2 Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
7.3 Notices for the settlement of disputes: Studydrive is not obliged or willing to participate in dispute resolution procedures through any consumer arbitration body. On the European online dispute resolution platform http://ec.europa.eu/consumers/odr you can find information about alternative dispute resolution (Please note: Currently we do not participate in this program).
