Terms and Conditions – Studydrive Premium

Introduction
These terms apply to the purchase of the paid Studydrive Premium subscription and take precedence over the general terms of use. In the event of any conflict between these terms and the general terms, the Studydrive Premium terms shall prevail. -
Conclusion of Contract
The contract for the Studydrive Premium service is between the customer ("you") and meinestadt.de GmbH, Jülicher Straße 26, 50674 Köln
By clicking the order button, you place a binding order. The contract is concluded when we confirm your order by email immediately after receiving it. -
Prices and Payment Terms
The prices displayed on the Studydrive website at the time of booking apply. All prices include VAT.
Depending on the selected minimum subscription term, a different monthly subscription fee will be agreed. The subscription fee for the selected minimum subscription term is due and payable immediately upon conclusion of the contract. Thereafter, the agreed subscription fee will be billed monthly.
Studydrive offers customers various payment methods, which are visible and can be selected during the ordering process. As of September 5, 2023, the following payment methods are available.

- Credit Card (Visa, Mastercard, Diners Club, American Express)
Studydrive reserves the right to accept additional payment methods and to deactivate existing ones. Invoices will be sent electronically via email to the email address you have provided. The same applies to payment reminders from Studydrive. You agree to inform Studydrive of any changes to your email address to enable possible communication with Studydrive.

Price Adjustment
Studydrive reserves the right to adjust the prices of the products or services offered in accordance with legal regulations. Price changes may occur, in particular, due to changes in cost factors, currency fluctuations, or other economic circumstances. In the event of a price adjustment, Studydrive will notify you in a timely manner. Notification of the price change will be sent in writing to the email address provided. The notification will include the new price, the date of the price change, and an explanation of the reasons for the price adjustment.
In the event of such a price adjustment, you have the right to terminate the contract extraordinarily and without notice from the time the price increase would take effect.

Payment Default and Account Suspension
If you default on payments, Studydrive may suspend your account. Your obligation to pay the subscription fee remains unaffected. -
Term and Termination
The contract runs for the term you booked, as stated in the product offer. The minimum term is specified in the product offer or in the relevant contract documents. Upon expiration of the minimum term, the subscription is extended indefinitely and can be canceled monthly.
You can cancel your subscription with two days' notice, at the earliest, until the end of the agreed minimum term. Once the minimum term has expired, you can cancel with two days' notice, effective at the end of the current month. You can cancel via your account under profile settings. Alternatively, you can send an email to info@studydrive.net.
Studydrive reserves the right to terminate the contract with 10 days' notice prior to the end of the agreed term. Notice of termination can be sent to you electronically via email.
The right to extraordinary termination remains unaffected for both you and Studydrive.
Contracts with a term of one month are always automatically extended for another month if they are not terminated by the customer or by Studydrive within the agreed time limit.
Contracts with a minimum term of more than one month are extended indefinitely at the agreed monthly price and can be terminated monthly.

Downloading and Sharing Study Materials
Premium users may download study materials for personal use only. Downloading is limited to 50 documents per day and 100 per month to prevent misuse. Sharing is only allowed via a platform link. -
Warranty and Liability of Studydrive
Statutory warranty rules for digital products/services apply. -
Communication
The user agrees to receive invoices and all communication as email attachments. The user agrees to provide a current email address for delivery and to promptly inform Studydrive of any changes to the email address. -
Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The cancellation period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us, meinestadt.de GmbH, Jülicher Straße 26, 50674 Köln, email: info@studydrive.net , of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.
Consequences of Withdrawal
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.
Exceptions
The right of withdrawal expires in the case of a contract for the delivery of digital content not stored on a physical data carrier if we have begun to execute the contract after you (i) have expressly agreed that we may begin to execute the contract before the expiry of the withdrawal period, (ii) have confirmed your knowledge that by giving your consent you will lose your right of withdrawal once the contract has begun to be executed, and (iii) we have provided you with your consent to immediate execution and confirmation of your knowledge of the expiry of the right of withdrawal as well as the other legally required information in the copy or confirmation of our contract on a durable medium.
